ANTI-MONEY LAUNDERING (AML)

It is the policy of Hudsons to undertake due care and diligence to ensure that it conducts its business only with reputable customers involved in lawful activities undertaken in good faith, and to create an effective Anti-Money Laundering (AML) regime throughout the businesses activities. Hudsons Anti-Money Laundering Procedure is regulated by HMRC.

Hudsons adheres to all current money laundering and terrorist financing prevention laws and regulations. Compliance is compulsory as any breach may result in a criminal offence punishable by UK law.

The regulations require that the estate agency businesses of Hudsons are registered with the HMRC.

  1. Money Laundering Officer Hudsons has appointed Robert Burwood as the MLRO. Any suspicious activity reports (SARs) are made by the MLRO and reported to the Serious Organised Crime Agency (SOCA). Any questions about this policy or money laundering issues generally should be directed to him.
  2. Training as part of the Group’s adherence to the regulations we ensure:-Hudsons are aware of the law relating to money laundering and terrorist financing Hudsons staff receive regular training on how to identify and deal with transactions which may be related to money laundering and terrorist financing.
  3. Procedures Records of all transactions are kept for 5 years.

Hudsons regularly monitors and reviews all its AML Procedures to ensure strict compliance in an efficient manner.

Hudsons AML Procedures and controls are updated from time to time to comply with any changes to the Regulations and to ensure that market best practice is adopted.

AML DOCUMENTATION REQUIRED

In order to transact with our customers we will need to gain the following original copies from one of each of the following (proof of address should be dated within the last 3 months).

Proof of Identity
  • Full current signed UK or English worded EU passport
  • Residential permit issued by the Home Office to EU nationals by the Home Office
  • Current UK/EU Driving licence signed with current address (With or without photo card)
  • Current state pension or benefits book
  • Inland revenue current tax year notification
  • Firearm/Shotgun certificate
Proof of Address
  • Most recent mortgage statement
  • Current local authority council tax bill
  • Local authority Rent card/book or Tenancy Agreement
  • Bank/Building society savings/credit card statements or passbook
  • Utility bill (not mobile phone) within last 3 months
  • Current UK/EU driving licence signed with current address (With or without photo card)
  • Current state pension or benefits book

PROBATE

If you are acting as a personal representative or executer of an estate we will require the original Grant of Probate or letter of administration as well as a proof of identity and address (from the list above) for each person mentioned in those documents as well as any additional names on the mortgage, other than the deceased.

LIMITED COMPANY

If you are acting as a Representative of a UK Company we will also require the following:

  • Certificate of Incorporation
  • Articles of Association
  • Memorandum of Association
  • Latest Annual Return or Confirmation Statement, with details of current company officers
  • If offshore, nominee director declaration and a general power of attorney
  • Proof of identity and address (from the list above) for all individuals or entities with 25% or more of the shares or voting rights in the company

If you are acting as a Representative of an Offshore Company we will also require the following:

  • Certificate of Incorporation
  • Articles of Association, Memorandum of Association, Latest Annual Return with details of current company officers, Share Certificate(s) showing the Ultimate Beneficial Owner OR
  • Certificate of Incumbency
  • If the shares are owned by another company, repeat steps above for the holding company
  • Nominee director declaration and/or general Power of Attorney (if applicable)
  • Proof of identity and address (from the list above) for all individuals or entities with 25% or more of the shares or voting rights in the company

TRUST

If you are acting as a Representative of a Trust we require the following:

  • Trust deed
  • List of trustees
  • List of beneficiaries
  • Proof of identity and address (from the list above) for all individuals with a vested interest in 25% or more of the capital and/or those who exercise control over the Trust
